How Texas Defines Robbery & Aggravated Robbery

Texas Penal Code § 29.02 connects robbery to theft. A person may be accused of robbery when, in the course of committing theft and with intent to obtain or maintain control of property, the person causes bodily injury or uses a qualifying threat. The phrase “in the course of committing theft” covers an attempted theft, a completed theft, and immediate flight after either one.

The injury-based form requires an allegation that the accused intentionally, knowingly, or recklessly caused harm to another person. The threat-based form requires an allegation that the accused intentionally or knowingly threatened someone or placed that person in fear of imminent harm or death. Physical contact isn’t required for every robbery allegation, but the state must still prove the specific conduct charged.

Texas Penal Code § 29.03 defines aggravated robbery as robbery accompanied by an additional allegation. The charge may involve serious bodily injury, the use or exhibition of a deadly weapon, or specified conduct involving a person who is 65 or older or a disabled person.

Felony Penalties for a Texas Robbery Charge

Robbery under Texas Penal Code § 29.02 is a second-degree felony. A conviction carries a punishment range of two to 20 years in prison and a potential fine of up to $10,000. Aggravated robbery is a first-degree felony, making the exact charge and supporting allegations critical to the defense evaluation.

Questions about community supervision require charge-specific analysis. Eligibility can depend on the charged offense, deadly weapon allegations, the procedural posture of the case, and other individual circumstances. We review those details rather than assuming every case presents the same sentencing options.

Evaluating Defenses to a Robbery Allegation

The prosecution must prove every required element beyond a reasonable doubt. We evaluate whether the evidence supports the alleged theft, injury, or threat and establishes the required state of mind. That review may compare witness accounts with recordings and physical evidence.

Important issues in a robbery defense can include:

  • Theft allegations: Whether the evidence proves an attempted or completed theft and an intent to obtain or maintain control of property.
  • Injury allegations: Whether harm occurred and whether the accused caused it intentionally, knowingly, or recklessly.
  • Threat allegations: Whether the conduct amounted to a threat of imminent harm or death.
  • Identity evidence: Whether witnesses, recordings, or other evidence reliably connect the accused to the alleged conduct.

Self-defense may apply when supported by the facts. In general, a self-defense claim requires a reasonable belief of imminent danger of harm or death and the use of reasonable force under the circumstances. We examine whether our client was attacked first, what danger appeared imminent, and whether the force used was reasonable.

How an Erath County Robbery Case Moves Forward

A felony robbery case in Erath County is handled at the district-court level by the 266th Judicial District Court. Proceedings can move from indictment and pretrial motions to trial or sentencing. Bond and probation issues may also arise. The order and timing depend on the allegations, the court schedule, bond conditions, and the case’s procedural status.

During a free initial consultation, we listen to what happened, discuss the charge, and outline what the next several weeks may look like. You can bring bond documents, charging information, or hearing notices for us to review. Attorney Landon Northcutt has defended clients in more than 100 Texas counties and draws on that experience to assess the procedural and evidentiary issues in each case.

After the initial review, we can investigate the state’s allegations, examine evidence, file pretrial motions, and conduct negotiations. If the case proceeds to trial, we prepare to challenge the state’s proof before the court or jury. The appropriate course depends on the evidence, available defenses, and the client’s priorities.
